I obtained copies of new documentation filed in this case yesterday. It can be a gamble choosing from a list of documents not really knowing what you'll get until after you've paid for them but the choices I made were worth the effort.

I'm sure the new incarnation fans will be pleased to know that the Defense has filed an Appeal Of The Statement Of Decision and Prem Injunction on Sep 16., just hours after the Judge Denied their motion to squash a subpeona. This subpeona served on Defendants from Plaintiffs asked for ALL of the accounting records to be submitted to the court and a net worth for a newly formed corporation called D21C.

A review of the Accounting submitted by Defendants shows personal salaries paid to RM and RK only. These salaries were paid through Doors Touring, Inc. The accounting submitted doesnot include all of the monies taken into and out of DTI instead it only shows two salaries supposedly earned at an undisclosed amount of new incarnation shows with the exception of two wire transfers from an Austrian promoter who paid RM and RK in equal shares. Partnership Tax Returns submitted for moneys are in the name of a Limited Liability Partnership called Diamond Night Productions, LLC a partnership shared equally by RM and RK formed in 2002. The taxpayers on the returns are filed in each RM and RK's trust accounts respectively. All profits are split equally which show a gross amount less than $99K for each return. Each return shows an amount for Foreign tax paid from each taxpayer but doesnot disclose the final amount less taxes paid.

A few misc. receipts are included in the accounting along with paychecks again split equally for odd amounts which also show withholding for FICA, etc.

The Judge ordered in his Statement Of Decision that accounting was to be complete and in reference to that fact and under penalty of perjury RM and RK accountant Alan Goldman declared the accounting submisison acurate.

Plaintiffs filed an objection requesting the Judge to make good on the Decision submitted on July 21 2005 which stipulates an accurate accounting. The objection goes further considering the fact that DTI is shown to pay out RM and RK salaries, where is the rest of the money that flowed in and out of that enity enabling payments to be made? The Objection asks for the "net worth" of a new corporation formed on June 8 2005 called D21C, Inc.

Defendants filed a motion to squash the subpoena served by Plaintiffs which requested all of the accounting figures for any enitity using The Doors name prior to the July 22. This would include DTI and D21C. In this motion the Defense also requested the date for submission of the accounting be changed to Sep 15 of which a day early date was granted.

The Judge considered the motion to squash subpoena and in a Sep 15 (filed Sep 20) ruling he ordered:

"Defendant Cross-Complainants RAYMOND MANZAREK and ROBERT KRIEGER and IAN ASTBURY and DOORS TOURING, INC. and third-party Alan Goldman’s Motion to Quash Subpoena is DENIED.

Document Request No. 11 should redact the request for “net worth.” "

Document request No. 11 calls for Defendants to supply the Plaintiffs with a net worth for D21C, Inc. The word "redact" means: (noun) someone who puts text into appropriate form for publication, (verb) prepare for publication or presentation by correcting, revising, or adapting; "Edit a a book on lexical semantics"; "she edited the letters of the politician so as to omit the most personal passages" .

Within hours of the Judges Ruling of Sep 15 Defendants filed an Appeal on the morning of Sep 16. This Appeal is for the Statement of Decision and Perm Injunction.

I'll get the information together in better fashion so I can turn it into another article. It looks as though this case will continue to drag on.

Hi Matt and thanks for your reply. You brought up an excellent point. I wish I had more information to give you as to why an Appeal was filed but everything I have is based on the documents I obtained yesterday.

I'm working on transcripts which shouldn't take too long so they can be added to the Trial Info already posted on the board.

This thread I started is based on a summary taken from the documents I have. I cannot find where the word "mistrial" comes up in the Ruling from Judge Greg Sep 15 2005. The Appeal document is in typical document form where one box is checked under Other: Statement Of Decision and Perm Injunction. Its only 2 pages long and contains no other information as to why the Defense is filing an Appeal.

1) they are utterly stupid and just want to waste money....hope they get slaughtered and have to pay everyones costs and go bankrupt.....

The fact that Defendants are "Appealing" has finally made it to as a news source at L.A. Woman Confidential. The news was reported as an addition to the cancellation of the VH-1 Show taped this past summer. After reading the news entry it appear that the Defendants become the "victim" once again which seems to be a frequent tactic used in their defense heaping the blame on John Densmore.

This all could have been avoided had the defendants adhere to the Order of the Court, but that fact is nowhere to be found in this news segment.

This news makes me sick. Somebody, tell me it isn't true! I have been in touch with VH1 trying to find out why this Saturday's premiere episode of VH1 Decades Rock starring Robby, Ray and Ian and numerous musical guests, is not on their schedule and has not gotten any hype or promotion. The unbelievable answer is that one of the members of The Doors has not agreed to the sync licenses necessary for the broadcast. That's right, even those songs penned by Robby Krieger are therefore blocked from use. As it now stands, this show may never see the light of day. The millions of fans worldwide who have been waiting for this broadcast, can figure out for themselves who to thank.

In early August, the two band members who are still proud to be members of The Doors, played a special show in Atlantic City at Trump Taj Mahal. It was a special occasion AND a special honor, because that performance was recorded by VH1 and would be the premiere episode of their new Decades Rock series. Just try to imagine what VH1's production costs for that endeavor must have been!

The VH-1 taping was promoted as an appearance by "The Doors Of The 21st Century." VH-1 taped the show on August 5. A court order was issued on July 21 which barred defendants from using the name after that date. Instead of abiding by that court order the name was still used in promotion for the VH-1 taping. Once the taping got underway on August 5, Manzarek made the announcement that the band would be called Riders On The Storm.

The Supplemental Declaration of S. Jerome Mandel dated June 10 2005 addresses the "VH-1 Decades Of Rock" taping that was scheduled for Aug 5 2005. Shortly after this Declaration was entered into evidence the Order For Perm Injunction was issued by the Court on July 21 2005 which prohibits the use of The Doors name.

Obviously Manzarek and Krieger disregarded this Perm Injunction as evidenced by their continuation to promote their band by using The Doors name. The name change was not reflected until during the taping of the VH-1 Decades show Ray said the band would be called Riders On The Storm.

WHAT HAS HAPPENED TO OUR BAND? It most visibly began when John declined (refused?) to join Ray and Robby when the band was invited to play to thousands of fans, old & new & future, when Harley-Davidson offered them the headlining slot on the opening night of their year-long, 100th anniversary celebration in 2002. There were offers made to accommodate John's tinnitus with special equipment; John declined (refused?) to join his band mates, but gave his blessing for Ray and Robby to go forward. Six months later, John filed a lawsuit against his band mates to prevent them from touring and using the band name that has given them all comfortable lives. Two and a half years later, and many millions of dollars long gone, the lawsuit continues to become uglier and more bitter than I could ever have imagined in my worst-scenario fears.

While claiming that it was not about the money, but rather 'protecting the legacy' ... you would gasp to know how much money Plaintiff Densmore is pursuing. So, is it over yet? Absolutely not! Meanwhile, Ray and Robby have continued to tour, bringing the live music of The Doors to hundreds of thousands of fans in something like 80 cities in 20 countries on 4 continents.

Again the news entry blames Densmore in asking for $11 million dollars. This figure as you know comes from the Plaintiffs objection document which reflects Plaintiffs views on the penalties that should be imposed on Defendants for not following the court order as prescribed on July 21, 2005. Still in definance of that court order Defendants chose to file an Appeal in lieu of relinquishing their "accounting" documents set forth in the Statement Of Decision.

Following the VH-1 performance Manzarek's announcement of the name change to ROTS during the live taping of the show was echoed in the media:

Doors founders Ray Manzarek and Robby Krieger have gone back to their past to rename their group. Manzarek announced on Friday (August 5th) that the group which was recently known as the Doors Of The 21st Century would now be called Riders On The Storm. From the stage, Manzarek said that "Riders On The Storm" was both the last song the late Jim Morrison recorded with the Doors, and the last one he ever sang with them. The news came as the band shot their Decades Rock Live TV show in Atlantic City, New Jersey, with guests including Vanilla Fudge, Pat Travers, and the Lovin Spoonful's John Sebastian. The special will air on VH1 Classic in the autumn.

After Doors drummer John Densmore and the estates of Morrison and his widow Pamela Courson filed suit, a judge recently issued a permanent injunction against Krieger and Manzarek that bars them from using the word "Doors" in their band name.

While neither side has ever confirmed it, there have been rumors over the years that Manzarek and Densmore don't like each other. That makes the choice of Riders On The Storm as a band name interesting, since Densmore used Riders On The Storm: My Life With Jim Morrison And The Doors as the title of his 1990 book about his time with Morrison.

Prior to the taping of the VH-1 on June 10 2005, Plaintiffs attorney, S. Jermome Mandel submitted a declaration which in part addressed the subject of the VH-1 taping on Aug 5, 2005. Following this declaration the Judge granted a Perm Injunction on July 21, 2005 stating in part that Ray and Co could not use the Doors name. The promotion of the VH-1 show featuring The Doors Of The 21st Century continued up to and through the taping of the show at which time Manzarek announced that the new name was ROTS.

By using the Doors name after July 21, 2005 Ray and Co. dishonored the court order and therefore it would seem logical for the VH-1 show not to be aired due to the defendants actions. John Densmore is not to blame here for the actions taken by Ray and Co in continuing to use the Doors name when they were ordered by a court of law not to do so.

Following the VH-1 performance Manzarek's announcement of the name change to ROTS during the live taping of the show was echoed in the media:

Doors founders Ray Manzarek and Robby Krieger have gone back to their past to rename their group. Manzarek announced on Friday (August 5th) that the group which was recently known as the Doors Of The 21st Century would now be called Riders On The Storm. From the stage, Manzarek said that "Riders On The Storm" was both the last song the late Jim Morrison recorded with the Doors, and the last one he ever sang with them. The news came as the band shot their Decades Rock Live TV show in Atlantic City, New Jersey, with guests including Vanilla Fudge, Pat Travers, and the Lovin Spoonful's John Sebastian. The special will air on VH1 Classic in the autumn.

After Doors drummer John Densmore and the estates of Morrison and his widow Pamela Courson filed suit, a judge recently issued a permanent injunction against Krieger and Manzarek that bars them from using the word "Doors" in their band name.

While neither side has ever confirmed it, there have been rumors over the years that Manzarek and Densmore don't like each other. That makes the choice of Riders On The Storm as a band name interesting, since Densmore used Riders On The Storm: My Life With Jim Morrison And The Doors as the title of his 1990 book about his time with Morrison.

I meant during the actual taping of the show "The Doors of the 21st Century" was never spoken. They were introduced as Ray and Robby of The Doors and Ian as the voice of the cult. It was advertised D21C before the injunction was handed down
